California Sues 3M And Others For Water Contamination From Firefighting Foam

Sunday, November 13, 2022 - It may be just a matter of time before all 50 US states file lawsuits against 3M, DuPont de Nemours Inc., the Chemours Co., and dozens of other companies for negligence over producing products that contain toxic PFAS forever chemicals. The trend toward litigation appears to be gaining steam. About three weeks ago, North Carolina Attorney General Joel Stein filed two PFAS water lawsuits accusing the companies of producing and selling "aqueous film-forming foam (AFFF), which contains per- and polyfluoroalkyl substances (PFAS," according to Bloomberg News. The lawsuits targeted the Camp Lejeune Marine Base in North Carolina and Piedmont-Triad International Airport nearby. The Federal Aviation Administration (FAA) has mandated using AFFF at airports around the nation to help quickly extinguish jet-fuel fires that could kill hundreds of people trapped aboard an airplane. Instead of saving lives, AFFF may have claimed hundreds of thousands of lives due to developing cancer from ingesting the PFAS forever chemicals in firefighting foam. The State of California is now following the lead of North Carolina in using the court system to attempt to force the makers of AFFF to clean the environmental catastrophe they have allegedly made. Both the North Carolina and California AGs agree that the companies knew about the problems forever chemicals in AFFF would cause to the environment and human health and looked the other way without warning the public. According to Fortune.com, California Attorney General Rob Bonta said using AFFF has had "pernicious effects on the environment and public health."

Interesting to note that a growing number of firefighters and first responders that trained regularly with AFFF and developed cancer at a young age have also filed PFAS cancer lawsuits against AFFF manufacturers. Bloomberg Law quotes AG Stein as saying, "In our filing with the court, we allege that these companies that made firefighting foam knew well how dangerous it was to our first responders and our natural resources," Stein said in a statement. "But they continued to sell this product to line their pockets at the expense of our health and our drinking water." In February of 2022, about 20 firefighters filed a joint lawsuit against 3M and other manufacturers of AFFF alleging that the companies knowingly sold a product that contained PFAS forever chemicals. PFAS chemicals are not only found in AFFF firefighting foam, but also in the flame-retardant equipment that firefighters use. "The case is the latest in a growing number of lawsuits from firefighters' attorneys citing crises that the chemicals, per- and polyfluoroalkyl substances, or PFAS, found in their protective jackets, pants, and other gear and specialized firefighting foam increase their risk of cancer, liver damage, and a host of other illnesses," BloomberLaw wrote earlier this year. Water contamination lawsuits continue to grow as the public becomes aware that their tap water may have been responsible for causing cancer. Communities near military bases and airports are concerned that the manufacturers of PFAS chemical products may have poisoned their families.
